You acknowledge and agree that esta-service.us (‘EstaService’) is not a law firm or an attorney, cannot perform services that an attorney provides, and its forms or templates are not substitutes for legal advice or services. You are representing yourself in this legal matter. No attorney-client relationship or privilege is created through the use of EstaService or its website located at estaservice.us (our “site”). Your use of this website indicates that you agree to and understand the Disclaimers, Privacy, and Refund policies stated on this website.

These Terms of Service include a binding arbitration agreement that resolves disputes on an individual basis, rather than through jury trials or class actions, and limits the remedies available to you in the event of a dispute.

You consent to receive electronic communications from EstaService as part of our services. We may assign a unique email address to your account to help EstaService receive notices from the government body processing your travel document and submitting your application. If you wish to stop using this email associated with your account or stop receiving notices about your application, please notify us by emailing [email protected].

EstaService’s review of your answers is limited to checking for completeness, spelling, and internal consistency of names, addresses, and similar information. You will read the final application(s) before signing it and are solely responsible for its content.

Accuracy of Information and Third-Party Consent

By signing this agreement, you guarantee to the best of your knowledge the accuracy and correctness of all information provided to EstaService. You also agree to our third-party processing authorizations, which involve using your data and digital signature.

Electronic Records and Signatures

You consent to EstaService affixing your electronic signature where required and filing the necessary documents for the service you purchased. You have the right to withdraw your consent at any time by contacting us at [email protected], which will result in the immediate discontinuation of our services.

Non-English-Speaking Customers

Materials provided by EstaService, including questionnaires, documents, instructions, and filings, are only available in English. Non-English translations of these Terms, and other terms, conditions, and policies, are provided for convenience only. In case of any ambiguity or conflict between translations, the English version is authoritative.

Limitation of Liability and Indemnification

Except as prohibited by law, you will hold EstaService and its officers, directors, employees, and agents harmless for any indirect, punitive, special, incidental, or consequential damage, however arising (including attorneys’ fees and related costs of litigation and arbitration), whether in an action of contract, negligence, or other tortious action, or arising out of or in connection with this agreement. This includes any claim for personal injury or property damage, even if EstaService has been previously advised of the possibility of such damage. If there is liability found on the part of EstaService, it will be limited to the amount paid for the products and/or services, and under no circumstances will there be consequential or punitive damages. Some jurisdictions do not allow the exclusion or limitation of certain damages, so these limitations may not apply to you.

Third-Party Services

If your purchase involves third-party services, you may need to accept additional terms on the third party’s website. The third party may contact you by email and/or phone with instructions on accessing your benefits. EstaService disclaims liability for any information, materials, products, or services posted or offered as part of third-party services. EstaService is not liable for any failure of products or services offered or advertised on those websites. Be aware that third-party companies have different privacy policies and may offer a lower level of security than EstaService.

Future Products and Services

If you add a product or service to your order after the initial purchase, these Terms of Service will also apply to that additional purchase.

Governing Law

These Terms of Use and your use of this website shall be governed by and construed according to the laws of the Commonwealth of Puerto Rico, USA, without regard to any principles of conflicts of law.

Timing of Claims

Any cause of action or claim you may have with respect to this website (including the purchase of any products and/or services) must be commenced within one (1) year after the claim or cause of action arises.

Arbitration and Venue

Any dispute relating to your visit to this website shall be submitted to confidential arbitration in the Commonwealth of Puerto Rico, USA, except for disputes relating to intellectual property rights, for which we may seek relief in any state or federal court. Arbitration shall be conducted under the rules of the American Arbitration Association according to its Commercial Arbitration Rules before a single arbitrator with expertise in the dispute’s subject matter. Arbitration expenses charged by the arbitrator shall be borne by the prevailing party or as allocated by the arbitrator. Each party shall bear its own legal fees and costs. Arbitration shall be completed within 120 days of either giving notice or filing a demand to arbitrate.

Final Arbitration

The arbitrator’s award shall be binding and may be entered as a judgment in any court of competent jurisdiction in the Commonwealth of Puerto Rico, USA. All arbitration testimony, evidence, rulings, and documentation shall be considered confidential. Neither party may use, disclose, or divulge such information unless required by law.

Class Action Waiver

To the fullest extent permitted by law, no arbitration under these Terms of Service shall be joined to an arbitration involving any other party. You agree to arbitration on an individual basis. Neither you nor we will join or consolidate claims in court or arbitration or participate in any claim as a class representative or member. Challenges to the class arbitration waiver may only be raised in a court of competent jurisdiction.

Suspended Accounts

We reserve the right, but are not obligated, to monitor, suspend, terminate, edit, disclose, refuse to post, or remove any material, content, and/or activity on this website for any reason at our sole discretion. We do not and cannot review all materials submitted to this website. If notified, we may investigate allegations of content violating these Terms of Service and determine whether to remove the communication. We assume no responsibility or liability arising from any actions or content transmitted by you or any third party within or outside of this website.

Filing Fees

Listed prices for application preparation assistance services do not include government application, medical examination, filing, or biometrics fees, which are non-refundable. See the Refund Policy at [provide link].

Reviews

After your purchase, you may receive an email survey request from EstaService. You may also write a review on the website. If you complete the survey or submit a review, your opinions may be posted on the website or used in marketing material, accompanied by limited identifying information such as your first name and last initial, product purchased, gender, city/state, and age range.

Force Majeure

EstaService shall not be in breach of or default under these Terms of Service or any contract with you or any other user and shall not be liable for any cessation, interruption, or delay in the performance of its obligations due to a Force Majeure Event, such as natural disasters, epidemics, war, or any similar event beyond our reasonable control. If a Force Majeure Event continues for more than 60 days, EstaService may terminate these Terms of Service without liability.

Right to Refuse

You acknowledge that EstaService reserves the right to refuse service to anyone.

These terms affect your legal rights and obligations. If you do not agree to all these terms, do not use this service. By proceeding with your purchase, you agree to these Terms of Service.
